Terms and Conditions

1. Scope & contracting party

These terms apply to all orders placed in the online shop himalayavibes.com. Your contracting party is:

By placing an order, you accept these terms in the version valid at the time of your order.

2. Customer account

To place an order, you must be of legal age and provide correct, up-to-date information. If you create a customer account, you are responsible for keeping your login details secure.

3. Products

Many of our products are handmade. Small variations in colour, pattern or size are therefore possible; they are not a defect but part of their character. Colours may look different depending on your screen. All offers are valid while stocks last.

4. Ordering & conclusion of contract

By submitting your order, you make a binding offer to purchase. The contract is concluded as soon as we confirm your order by email or ship the goods. We may decline orders for good reason, for example in the case of obvious pricing errors or if an item is no longer available. In that case, we will refund any amounts already paid in full.

5. Prices & payment

All prices are in Swiss francs (CHF). Shipping costs are shown separately at checkout. The price at the time of your order applies.

We accept the payment methods shown at checkout, including TWINT, credit card, PayPal, Apple Pay, Google Pay and Klarna.

6. Shipping & delivery

All information on shipping costs, delivery times and the minimum order value for the EU can be found in our shipping policy. Delivery times are estimates. We cannot be held liable for delays caused by the postal service, customs or events beyond our control.

For deliveries to Switzerland and Liechtenstein, risk passes to you when the parcel is handed over to the postal service. For deliveries to consumers in the EU, risk only passes on delivery.

7. Unclaimed parcels

If a parcel is not collected and is returned to us, the purchase contract remains valid. We will contact you by email and offer to reship it at your expense.

If we do not hear from you within 3 days, we may cancel the order. In that case, we will deduct the original shipping costs, the return shipping costs and any handling fees from the refund.

8. Returns & withdrawal

In Switzerland there is no statutory right of withdrawal for online purchases. We voluntarily grant you a 14-day right of return. Customers in the EU have the statutory right of withdrawal. You will find all details in our return policy.

9. Warranty

Please check the goods on receipt and report any defects or transport damage to us within 7 days, with photos. For justified defects, we will offer a replacement, repair or refund at our discretion. Mandatory statutory warranty rights, in particular for consumers in the EU, remain unaffected.

10. Liability

We are liable for damage caused intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Mandatory statutory liability provisions, such as the Product Liability Act, remain unaffected.

11. Intellectual property

All content on this website (texts, photos, logos, videos) belongs to Himalaya Vibes or is used with permission. Use without our written consent is not permitted.

12. Links & third parties

Our website may contain links to other websites or third-party tools. We accept no responsibility for their content or functionality.

13. Data protection

You can find out how we process your data in our privacy policy.

14. Applicable law & place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Bern. Mandatory places of jurisdiction and consumer protection provisions remain reserved.

15. Changes

We may amend these terms. The version published at the time of your order applies to your order.
